ARTICLE 1. PURPOSE OF THE SERVICE

  • Bicycle transport is an alternative to mobility in Sibiu.

This policy sets out the conditions under which users may use and access the SIBIU BikeCity system. The use of a bicycle by this service implies the express acceptance of all the conditions set out in these regulations.

The main goal of the SIBIU BikeCity project is to use the bicycle as an alternative to other polluting means of transport, an environmentally friendly alternative to reduce carbon dioxide emissions.

FREE SERVICE AUTOMATIC BIKE RENTAL SYSTEM – SIBIU BikeCity, hereinafter referred to as “System”, is a service offered and operated by the City of Sibiu, through the Public Administration Service of the Public and Private Domain of Sibiu (SPADPP Sibiu).

  • The system consists of placing self-service automatic bicycle rental stations on the public domain of the Municipality of Sibiu, each equipped with a payment / information terminal and secure locations for docking bicycles. . The system allows the user to rent a bike according to the terms described in this regulation.
  • A fleet of 540 bicycles, 8 tricycles for seniors and 4 tricycles for people with disabilities will be made available to users, spread over 44 locations located in different areas of the city.

All references to bicycles in this Regulation also include tricycles.

  • Access to the SIBIU BikeCity System is subject to the acceptance of the general conditions, as well as the note on the processing of personal data, valid at the time of use of the system and which may change at any time during the operation of the system. . The general conditions of processing of personal data are communicated before and during the use of the service and are deemed accepted by continuing the procedures for the use of bicycle rental services.

ARTICLE 2. SERVICE AVAILABILITY

  • Rental hours are from 06:00 to 24:00, Monday to Sunday.
  • The system is available all year round, except during the cold season. Depending on the weather conditions in this cold season or other exceptional situations, the usage schedule may differ.
  • The Public Service of the Administration of the Public and Private Domain Sibiu is not liable for damages caused by the suspension of the program of use of the bicycle rental system for the reasons mentioned above. In the event of a system shutdown or interruption, the operator will endeavor to inform the user in real time of the conditions of availability of the system through the website, the application or any other means of communication / information.
  • The aim of the system is to use the bicycle as an alternative to polluting means of transport, avoiding traffic jams and increasing mobility in Sibiu.

ARTICLE 3. USE OF THE SYSTEM

  • The SIBIU BikeCity system is accessible to anyone named ” user ” under the following conditions:
  • be over 14 years of age on the date of registration;
  • be fit for cycling and have no medical contraindications;
  • comply with the provisions of GEO no. 195/2002 concerning traffic on public roads , with subsequent amendments and complements;
  • comply with the provisions of TD no. 1391/2006, for the approval of the OGE Implementing Regulation no. 195/2002 concerning traffic on public roads, with subsequent amendments and complements.
  • Senior tricycles are intended and can only be used by this category of users.
  • The adapted tricycles with pedaling system accessible to the disabled are intended and can only be used by this category of users.
  • The system shall be accessible to both “registered users ” and “unregistered users ” upon payment of the prescribed fee and in accordance with the procedure described in this Regulation. Unless otherwise stated in this Regulation, any reference to the user shall refer to both “registered users ” and ” unregistered users “.
  • registered users , only one account can be opened and one subscription can be issued per person, and to access and use the bike rental system via the SIBIU BikeCity system, users have the following options to create and validate an account user:
  • use of public devices to access the Public Bike System Company (PBSC) application available on GooglePlay, the App Store;
  • use of the smart terminal located in bicycle rental stations;

  • Registered user status requires, in addition to creating and activating a registered user account , providing personally identifiable information, providing a valid email address, telephone number, and adding and register a method of payment (credit card), as well as certain validation measures.
  • All users of the system are required to read and agree to the terms and conditions before using the system for the first time.
  • The simple use of the system implies the full and unreserved acceptance by any user (registered or unregistered) of all the conditions set out in these regulations and in the general conditions of use of the system, and no handwritten signature is required for the user’s agreement on the content of the terms and conditions or the electronics.

ARTICLE 4. BICYCLE RENTAL RATES AND TERMS

SECTION I. – Rental rates and durations

A bonus of 10 hours (600 minutes) is awarded to registered users who have used the bike for more than 40 hours during a calendar month.

The bonus is granted at the beginning of the following month ***.

  • The rented bike will be returned in accordance with the conditions of use. Failure to comply means a penalty will be applied .

If the bike is not returned within a maximum of 12 hours (from the expiration of the return period, respectively 24:00) , the loss of the bike is considered suspicious, which means that the appropriate authorities will be notified.

  • Fees paid are final and cannot be refunded for any reason.
  • In addition to the above costs, all other costs associated with the need for repair, repair or replacement in the event of damage, destruction or damage of any kind resulting from improper use of the bicycles will be added.
  • The town hall of Sibiu can make the provision of bicycles free of charge for competitions, authorized events, other situations.

TITLE II. – Rent and return the bike

  • Unlock your bike to start renting :

Bicycles can be rented at any SIBIU BikeCity rental station, subject to availability and during opening hours.

The conditions for taking care of the bike, the rights and obligations that apply at the time of rental are those posted on the website bikecity.sibiu.ro , in the application PBSC (Public Bike System Company) or in the stations of bicycle rental.

The user has the obligation to check the technical condition of the bike within the first 10 minutes after the rental. If it finds an existing defect, it must return the bike to the same station and inform the SIBIU BikeCity shipping office. There will be no charge for these 10 minutes.

  • There are several possibilities for picking up a bike at the bike rental station:
  • REGISTERED USERS

Note: A user account must be created in advance as specified in Article 3, Section I.

  • via the mobile application by scanning the QR code on your bike:
  • the registered user must be authenticated in the application;
  • select “Unlock using QR code” in the app.
  • choose the bike and scan the QR code, applied to the frame of the bike;
  • an audible signal and a green (green) signal on the docking system will confirm the release of the bike for use.

  • from the mobile application, by entering a digital code generated by the application, on the keyboard of the bicycle reception system:
  • the registered user must be authenticated in the application;
  • select “Unlock using digital code” from the app;
  • the bike is selected and the 5-digit numeric code is entered on the keyboard of the bicycle reception system;
  • an audible signal and a green (green) signal on the docking system will confirm the release of the bike for use.

  • using the smart terminal, by entering the digital code generated by the terminal, on the keyboard of the bicycle reception system:
  • the registered user connects to the smart terminal by following the steps displayed on the terminal screen;
  • select “Unlock using numeric code”;
  • choose the bike and enter the numeric code on the keyboard of the bike reception system;
  • an audible signal and a green (green) signal on the docking system will confirm the release of the bike for use.
  • UNREGISTERED USERS

Note: A valid credit card is required.

  • using the credit card at the smart terminal, by entering the digital code generated by the terminal, on the keyboard of the bicycle reception system
  • the bank card is scanned at the smart terminal;
  • select “Unlock using numeric code”;
  • choose the bike and enter the numeric code on the keyboard of the bike reception system;
  • an audible signal and a green (green) signal on the docking system will confirm the release of the bike for use.
  • Temporary locking of the bike outside a station during rental is only available to users who use the app on their mobile phone.
  1. If the user wishes to stop temporarily in other areas where there are no docking stations available nearby, they must ensure that they park their bike only on bike paths or in special places. fitted and uses only the locking devices intended for the bicycle, as follows:
  1. in the application, in the “current rental” window, choose the “temporary lock” option;
  2. the QR code of the bike is scanned to activate the connected padlock;
  3. unroll the fixing cable located in the basket and fix it around a fixed point (bicycle parking provided for this purpose);
  4. push the locking handle (from the wheel) down;
  5. insert the end of the cable in the slot provided on the padlock, making sure that the wheel is locked;
  6. the message “bike successfully locked” is displayed on the application screen.

IMPORTANT: During a temporary stop, the time continues to run and the bike remains the sole responsibility of the user.

  1. To make a temporary stop outside the station and continue his journey, the user performs the following operations:
  1. in the application, in the “current rental” window, choose the “unlock” option;
  2. the bike’s QR code is scanned to unlock the bike;
  3. remove the lock cable from the wheel lock and attach it to the bicycle basket;
  4. “Bike successfully unlocked” is displayed in the app.

  • Return of the bicycle to the bicycle terminals:
  1. Bicycles will only be returned to SIBIU BikeCity station lashing systems. To return a bike to the station after use, the user will attach the bike (initially unlocked at the time of rental) to the docking system. A green sound and light signal will confirm the repair and the rental period will be over. If the bike is not properly attached to the crutch, the beep is different and the color of the light is red. In this case, the user should try to repeat the bike repair procedure or call the SIBIU BikeCity dealer by phone if the problem persists.
  2. Exceptionally, in the event that all docking systems of a SIBIU BikeCity station are busy at some point, the user will be able to return the bike by locking it in the immediate vicinity of the station. The rental period can only be completed if the bike’s GPS system recognizes that it is in the preset virtual space of a SIBIU BikeCity station.
  • Restitution of bicycles in case of failure:

The user is required to inform the SIBIU BikeCity dealer of any events while using the bike and return it to the nearest station, after docking it to press the repair button provided on the system. docking.

In the event that the bike cannot be pursued, you must inform the SIBIU BikeCity distribution office and wait for the operator to carry out the procedures for taking care of the bike.

  • Detailed information and instructions regarding bicycle rental operations (e.g., account creation, account update / modification, use of the application, use of the terminal, use of the host system, etc.) will be provided. available on the system website at www.bikecity .sibiu.ro .

ARTICLE 5. RIGHTS AND OBLIGATIONS OF THE USER

  • The user has the right to use the bikes exclusively for his own use.
  • The rented equipment will be used exclusively by the user concerned and only for personal transport.
  • The user must use the bike only on routes and roads corresponding to his level of experience.
  • The user is required to return the recovered bicycle in a timely manner in accordance with these regulations and in the condition in which it was recovered, except for normal wear and tear.
  • The user agrees not to alienate the lifted bike and not to communicate the digital unlock code of the bike to another person.
  • The user agrees not to use the bike under conditions that could damage the bike.
  • The user is required not to exceed the maximum permissible loads of 150 kg per bicycle, including a maximum of 10 kg in the basket.
  • It is forbidden for the user to participate in cycling races or to practice extreme sports using the rented bicycle;
  • The user agrees not to sublet to third parties or not to use for other commercial or professional purposes (mail, product delivery, advertising, etc.).
  • The user is required to communicate or update his personal data whenever necessary.
  • The user is required to comply with the provisions of GEO no. 195/2002 on traffic on public roads, GD no. 1391/2006, for the approval of the OGE Implementing Regulation no. 195/2002 as well as other legal provisions regarding safe cycling on public roads or on specially designed tracks.
  • The user has the right to request and receive information regarding bicycle rental services.
  • The user is fully responsible in the event of an accident (road events, collisions, accidents, etc.) as well as damage of any kind (material, moral, bodily, etc.) caused to a third party when using the bicycle. . In this case, the SIBIU BikeCity Dispatcher has the obligation to inform the mobile phone number 0791 001 100 by telephone as soon as possible and then to provide copies of the documents prepared in these situations. The Public Service of the Administration of the Public and Private Domain Sibiu is not responsible in case of incidents / accidents / damages of any kind, caused by the use of bicycles by users.
  • The user is obliged to use the rented equipment under normal operating conditions, to avoid hitting or losing the subassemblies of the leased equipment and it is forbidden to transport bicycles by any means of transport without the agreement prior written notice from the operator. Otherwise, the Public Administration Service of the Public and Private Domain Sibiu may claim compensation for the market value of the missing repair or equipment (subset).
  • In case of malfunction during use (brakes, brake levers, joysticks, handlebars, saddle, frame, wheels, spokes, rims, chain, etc.), the user has the obligation to warn SIBIU BikeCity Dispatcher by phone to the mobile phone number 0791 001 100 . Repair or modification of the bike by the user is prohibited.
  • In the event of a bicycle theft, the user has the obligation to report the theft to the Sibiu Municipal Police as soon as possible, to inform the SIBIU BikeCity Dispatcher by telephone at the mobile phone number 0791 001 100 and to communicate. copies of the statement and documents (registered with the Sibiu police).
  • In special situations where it is found that the legal provisions of this regulation are not complied with, the Public Administration Service of the Public and Private Domain Sibiu may interrupt the use of the bicycle and ensure its transport to the reception stations or service, informing the user who rented the bike. .
  • For violation of the provisions of s. (1) – (16) of this article, the Public Administration Service of the Public and Private Domain may order by administrative measure the cancellation of the account and, if applicable, of the subscription and, if necessary, the application of a ban on access to the system.

ARTICLE 6. DATA CONFIDENTIALITY

  • The use of personal data will be made in accordance with the legal regulations in force on the protection of individuals with regard to the processing of personal data and the free movement of such data;
  • By registering and activating an account, the user expressly and unequivocally agrees that his personal data will be entered into the System database.
  • The Public Service Administration of the Public and Private Domain Sibiu will process personal data during the existence of the account only for the purpose of providing the service for which the account was created, and after deactivation of the account will process personal data in anonymous data and used for internal statistics purposes only.
  • The information provided by users will only be used to ensure the operation of the System, to continuously improve the operation of the System, to increase the quality of the services provided.
  • The Public Administration Service of the Public and Private Domain Sibiu will not transmit personal information to third parties, except in the following cases:
  1. with the consent of the user;
  2. if it is necessary to provide information to operate the SIBIU BikeCity self-service bicycle rental system;
  3. Personal information may be transmitted to public authorities or institutions in accordance with legal provisions or in good faith if:
  1. is provided for by a legal provision;
  2. protects the rights of the municipality of Sibiu;
  3. prevent crime or protect national security;
  4. protects the safety of the individual or public safety;
  5. other exceptional situations
  1. If the user’s activities violate the established terms and conditions or the instructions for use of the system;

ARTICLE 7. APPLICATION AND EXECUTION OF THE GENERAL RENTAL CONDITIONS

  • The terms of use of the SIBIU BikeCity Self-Service Bicycle Rental System apply to all uses and are available on the site and in the application.
  • The user agrees to read the terms and conditions of the System and to accept them before using the system for the first time, by checking the appropriate box. The user is informed that the simple use of the system implies full and unreserved acceptance of all the provisions.
  • The operator reserves the right to change the conditions at any time and without notice, it being understood that these changes will be applicable to uses after these changes. It is therefore imperative that the user consults and accepts the terms and conditions when using the system.
  • If any provision of the Terms of Use of the System is declared void, unlawful or unenforceable, in whole or in part, the other clauses will remain in effect and will continue to have full effect.

ARTICLE 8.  offenses

(1) The following acts constitute a contravention and are punishable by a fine of 200 lei to 300 lei for natural persons, if they have not been committed under conditions such that, according to the criminal law, they are considered as crimes:

  1. non-return of the rented bicycle, at the docking station, until 24:00 on the day of the rental;
  2. non-declaration by the user of the damage caused to the bicycle during its use;
  3. the use of the rented bicycle, in other areas and for other purposes in accordance with this Regulation;
  4. damage to or destruction of bicycle parts, docks, rental stations, repairs and modifications to bicycles;
  5. park bicycles outside bicycle racks or designated areas;
  6. improper use of tricycles or by other persons referred to in Article 3, para. 2 and 3.

(2) In addition to the primary penalty set out in this Regulation, the additional penalty for termination of the account and / or, as the case may be, the subscription may also be applied.

(3) In parallel with the application of the main sanction of the contravention, through the record of the finding of the contravention, it will be established at the expense of the offender and the obligation to pay the damages found in the established amount.

(4) The penalties for minor offenses set out in this Regulation shall be set out in the minutes of the finding and application of the sanction for a minor offense and may be applied to natural persons.

(5) The finding and sanctioning of offenses shall be carried out by the finding officers authorized by the mayor of the municipality of Sibiu.

(6) The minutes of the finding of an infringement shall include the mandatory particulars provided for in OG No. 2/2001, as subsequently amended and supplemented.

(7) This Regulation is supplemented by the provisions of OG No. 2/2001 on the legal regime of contraventions, with subsequent amendments and complements .
